Description

Abstract:

The area of land overlying the Howard South Groundwater Management Zone has been declared a Restricted Water Extraction Area under section 14A(1) of the Water Act 1992 due to insufficient groundwater availability.

The area of land overlying the Howard South GMZ spans 295.29 sqkm, from south of the Arnhem Highway and northwards along the Howard River (the area). It includes parts of Girraween, Howard Springs, Herbert, Humpty Doo, McMinns Lagoon, Lambells Lagoon and Wak Wak. Most of the titles across the area are large residential blocks which are a cornerstone of the Darwin rural lifestyle, with sprawling gardens, multiple dwellings and grazing stock. There are approximately 120 water licences, the majority of which support agricultural developments predominantly growing mango and Asian vegetables.

The effect of the RWEA will be to protect existing water users and landowners, ensuring that groundwater continues to be available to them, by preventing the number of owners of land with a right to take groundwater from increasing when new titles are created following a subdivision of land. New titles in the area created through subdivision will be required to source water from alternatives such as rainwater tanks. The effect of the declaration will only apply to the right to take groundwater under section 14 and will not restrict the right to take water from waterways under section 11.
